Due Diligence

This price/quotation list is issued subject to compliance by the buyer or third party (if any), and is not to be construed as a commitment or obligation, express or implied on the part of RGB. Due diligence is to be completed and submission for manufacturers’ approval before the acceptance of buyer’s confirmation or placement of goods.

The Buyer acknowledges that RGB and/or its affiliates are subject to licensing and regulatory requirements for gaming and related matters in various jurisdictions. The Buyer shall cooperate fully with RGB and its affiliates in completing the necessary Due Diligence related forms and providing information that deems necessary or appropriate in assuring itself that the Buyer possesses the good reputation applicable to those engaged in the gaming related industries. The Due Diligence is subject to RGB’s Compliance approval prior to the acceptance of Buyer’s confirmation/order.  RGB reserves the rights to request further information or supporting documents when its deemed necessary for the completion of Due Diligence.

Disclaimer

  1. Except as expressly provided in this website, to the maximum extent permitted by law, RGB disclaims all warranties, express or implied, in respect of the Products (including the software). If any warranty is implied in this website by any legislation, and the legislation avoids or prohibits provisions excluding or modifying such warranty, the warranty shall be deemed to be included in this website, provided that RGB’s liability for breach of the warranty shall, if the legislation permits, be limited, in the sole discretion of RGB, to:

    (a) the replacement of the Products or the supply of equivalent Products;

    (b) the repair of the Products;

    (c) the payment of the cost of replacing the Products or of acquiring equivalent Products; or

    (d) the payment of the cost of having the Products repaired.

  2. As the purchaser of the Products, you are responsible to ensure that your purchase is in full compliance with the laws of the country into which the Products are being imported. RGB disclaims all liability if you fail to obtain any approval/license required to own and operate the Products supplied by RGB in your country or if you fail to comply with any licensing laws or regulations or any other laws of your country in relation to the Products.  RGB will also not be responsible for any import duties and taxes which may be incurred.

Compliance With Bribery Laws

RGB adopts a zero-tolerance approach towards bribery and corruption as stated in its Anti-Bribery and Corruption Policy which is available at www.rgbgames.com and is committed to comply with its Anti-Bribery and Corruption Policy, the Malaysian Anti-Corruption Commission Act 2009 and any other applicable anti-bribery and corruption laws.

You warrant that you have not made or ordered any payment, taken any action, or directed any person to make any payment or take any action, and/or that you  will not make or order any payment, take any action, or direct any person to make any payment or take any action, that violates or could violate the Malaysian Anti-Corruption Commission Act 2009, the United States of America Foreign Corrupt Practices Act of 1977, the United Kingdom Bribery Act 2010 or any laws in any other jurisdiction that prohibits bribery and corrupt practices, including but not limited to the unlawful direct or indirect payments to governments, government officials, public bodies, public officials, political organisations, or political officials.

Force Majeure

Notwithstanding anything to the contrary contained in this website, RGB reserves the right absolutely to change the costs incurred for shipment resulting from acts beyond the reasonable control of RGB including but not limited to acts of God, acts of Government, war, terrorism, civil or military disturbances, earthquakes, fires, floods, strikes, disease, outbreak, global health emergencies, epidemics, riots.

In addition to the above, except for your payment obligations as stated in this website, neither you nor RGB  shall be in default hereunder by reason of its delay in the performance or failure to perform any of its obligations hereunder due to a Force Majeure Occurrence. A “Force Majeure Occurrence” is an event or effect that cannot be reasonably anticipated or controlled, for example: acts of war; civil unrest; terrorism; disease, global health emergencies, epidemics; fire, earthquake; flood; governmental interference; rationing; or any other cause which is beyond the control of the party affected and which, by the exercise of reasonable diligence, the affected Party is unable to prevent. The Party affected by a Force Majeure Occurrence shall promptly notify the other Party.

Privacy Policy

RGB is committed to protect the privacy and security of any personal data that Company may provide through the forms/surveys posted on-line. Personal data includes information that can be linked or directed to a specific individual for example name, address, phone number or email address. Should RGB asks the Company to provide certain information by which an individual/personnel can be identified when using this website, then the Company can be assured that it will only be used for such purpose it is requested.

RGB may collect data required to process payment for purchasing such as credit card or security code that is associated to complete the transaction.

Data collected might be shared with our Suppliers to fulfill Due Diligence requirement of the purchaser.

RGB may use your information for business purposes such as data analysis, identify purchase trends, promotional campaigns and marketing for better user experience.
